Under broad policy guidance and supervision of the City Manager, this exempt, at will employee, represents the City in civil litigation, drafts ordinances and resolutions, negotiates and prepares contracts, and advises the City on all legal matters as called upon.  Oversees the administration of the legal department.  Supervises the assistant city attorney and prosecutor, including fulfilling their responsibilities when they are absent. 


  • Advises the council, mayor, manager, department directors, and staff concerning laws, rules, and regulations which the City must comply with to function effectively and to avoid liability, or possible fines and 
  • Spanish Fork City currently has an inter-local agreement with Salem City and Utah Valley 911 to provide legal services to each entity. This position acts as general counsel to each entity, with all duties described herein applying to each entity.  The Legal Services Department provides the same legal services for both entities, in addition to Spanish Fork City.  This provision is subject to applicable agreements and negotiated changes. 
  • Prepares ordinances, resolutions, contracts, and other legal documents for the City to help protect it from liability and to ensure the safety and welfare of Spanish Fork citizens, while also preserving the wealth and aesthetic beauty the City has to offer. 
  • Provides legal representation for the City, or assists in the same, in those instances when there is no insurance coverage or when the City acts as plaintiff. 
  • Answers questions that City staff members and departments may have concerning the law. 
  • Provides training for the governing body, commissions, departments, boards, committees, etc. concerning the legal requirements of their respective responsibilities. 
  • Is a member of the Development Review Committee. 
  • Acts as the director of the legal department. Identifies and resolves problems. Makes oral and/or PowerPoint presentations to the City Council and various other boards, committees, and commissions. 
  • Prepares reports, correspondence, agreements, agenda items, legal opinions and other written documents. Conducts research; examines documents, case law, evidence, correspondence, and other written material. 
  • Works with service districts and inter-local entities the City belongs to. 
  • Is expected to attend City Council meetings and Development Review Committee meetings. 
  • Must be able to meet attendance and punctuality requirements for this position. Must abide by all city policies and procedures. Must work well with others and be a team player. 
  • Applicants will be required to submit to a criminal background check and drug test. 
  • Performs other duties as assigned or as necessary.                  


  • Education and Experience: Required to be a member of the Utah State Bar, with 10 years of legal experience with at least 5 of those years consisting of experience in municipal law. 
  • Necessary Knowledge, Skills, and Abilities: Must possess the ability to reason, write, communicate clearly, research, and analyze situations based upon legal principles. Ability to interact with the public and handle oneself in stressful situations and crises. Should be able to react quickly to unexpected dilemmas and conduct. Must understand the purpose and philosophies of land use law, open meetings law, and public employment law. Should possess a specialized understanding of municipal and public law. A generalized understanding of water law is helpful.  Should possess basic knowledge of general legal principles.
